1. Acceptance of Terms

Welcome to StratiZone ("Site", "Service", "we", "us", "our"). This Site provides an online directory for discovering, sharing, and discussing strategies, indicators, and libraries related to trading platforms and languages, including but not limited to Pine Script™ ("Scripts", "Content").

By accessing or using the Site in any manner, including but not limited to visiting or browsing the Site or contributing Content or other materials to the Site, you ("User", "you", "your") expressly agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy [Link to Privacy Policy - To Be Added Later], which is incorporated herein by reference and details our data collection and usage practices, including for analytics. If you do not agree to these Terms or the Privacy Policy, you may not access or use the Site.

2. Description of Service

StratiZone is a platform designed to facilitate the discovery and evaluation of trading tools and strategies. We provide a directory where creators can voluntarily submit their Content, and users can browse, search, filter, favorite, review, and rate this Content. The Site is intended as a resource for traders and developers interested in various trading platforms and technologies.

In Phase 1, all core features, including browsing, searching, submitting Content, rating, commenting, and managing profiles, are provided free of charge to users. The platform supports its operations through advertising and affiliate relationships, as detailed further in these Terms. We may also collect usage data to analyze and improve the Service, as outlined in our Privacy Policy.

3. No Affiliation with TradingView® or Other Platforms

StratiZone is an independent website and service. We are not affiliated with, associated with, authorized by, endorsed by, or in any way officially connected with TradingView, Inc., or any other trading platform provider mentioned on the site, unless explicitly stated otherwise. The official TradingView website can be found at tradingview.com. Names like TradingView®, MetaTrader®, NinjaTrader®, etc., as well as related names, marks, emblems, and images are registered trademarks of their respective owners. Our focus is on providing a directory for tools related to these platforms.

4. User Accounts

  • Registration: To submit Scripts or Reviews, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • Email Verification: Account activation requires verification of your email address.
  • Account Security: You are responsible for safeguarding your password and any other credentials used to access your account. You are solely responsible for any activity that occurs through your account, whether or not authorized by you. You agree to notify us immediately of any unauthorized use of your account.
  • Account Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice or liability, for conduct that we believe violates these Terms or is harmful to other users of the Site, us, or third parties, or for any other reason.

5. User-Generated Content (Scripts, Reviews, Comments, Profile Information)

  • Voluntary Submission: All Scripts, reviews, comments, profile information (including optional donation links provided by creators), and other materials submitted or posted to the Site by users ("User Content") are submitted voluntarily. StratiZone does not scrape or automatically collect Scripts from TradingView® or any other source. Creators choose to share their work on this platform. A script's presence on StratiZone does not imply its presence or absence on any other platform.
  • License Grant: By submitting User Content to the Site, you grant StratiZone a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, host, store, reproduce, modify (solely for formatting or display purposes), adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in connection with operating, promoting, and improving the Service and for developing new ones. This license continues even if you stop using our Services.
  • Responsibility: You are solely responsible for the User Content you submit and the consequences of submitting and publishing it. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the User Content you submit and to grant the license set forth herein.
  • Intellectual Property of Submissions: You retain all of your ownership rights in your User Content (e.g., the copyright to your code). However, by submitting User Content, you grant the license described above.
  • Prohibited Content: You agree not to submit User Content that:
    • Infringes any third party's copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy;
    • Violates any law, statute, ordinance, or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, or false advertising);
    • Is defamatory, trade libelous, unlawfully threatening, or unlawfully harassing;
    • Is obscene, pornographic, or harmful to minors;
    • Contains any viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or personal information;
    • Constitutes spam, unsolicited advertising, or chain letters;
    • Promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous.
  • Moderation: We reserve the right, but do not assume the obligation, to review, screen, refuse, remove, or edit any User Content at our sole discretion and without notice, particularly content that violates these Terms or is otherwise objectionable. User Content may require approval before becoming publicly visible on the Site. Failure to comply with content guidelines may result in content removal or account suspension.

6. Intellectual Property Rights

  • Our Content: The Site and its original content (excluding User Content), features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by StratiZone, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
  • Respect for Others' IP: StratiZone respects the intellectual property rights of others. We are committed to complying with copyright and other intellectual property laws. We will respond to notices of alleged copyright infringement that comply with applicable law. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us with the necessary information as outlined by applicable law (e.g., DMCA or equivalent process). 7. Disclaimers

  • "AS IS" Basis: THE SITE, SERVICE, AND ALL CONTENT (INCLUDING USER CONTENT) ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, StratiZone, ITS AFFILIATES, AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
  • No Warranty on Content: WE DO NOT WARRANT THAT THE CONTENT (INCLUDING SCRIPTS, REVIEWS, OR OTHER USER CONTENT) AVAILABLE ON OR THROUGH THE SITE IS ACCURATE, RELIABLE, CORRECT, COMPLETE, UP-TO-DATE, OR FREE OF ERRORS. WE DO NOT WARRANT THAT ANY SCRIPT WILL PERFORM AS DESCRIBED, IS FREE FROM BUGS OR REPAINTING ISSUES, OR IS SUITABLE FOR ANY PARTICULAR TRADING STRATEGY OR PURPOSE.
  • No Warranty on Service: WE DO NOT WARRANT THAT THE SITE OR SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE FROM ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.
  • Not Financial Advice: ALL CONTENT PROVIDED ON THE SITE IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. IT DOES NOT CONSTITUTE FINANCIAL ADVICE, INVESTMENT ADVICE, TRADING ADVICE, OR ANY OTHER SORT OF ADVICE, AND YOU SHOULD NOT TREAT ANY OF THE SITE'S CONTENT AS SUCH. 8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL StratiZone, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE OR ANY CONTENT ON THE SITE. UNDER NO CIRCUMSTANCES WILL StratiZone BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT PAID BY YOU, IF ANY, FOR USING THE SERVICE DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE CLAIM ARISING.

THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF StratiZone HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

9. Indemnification

You agree to defend, indemnify, and hold harmless StratiZone, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your User Content, any use of the Site's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site.

10. Third-Party Links, Advertising, and Affiliate Relationships

The Site may contain links to third-party websites, services, advertisements, or content that are not owned or controlled by StratiZone (collectively, "Third-Party Content"). These links and advertisements may be provided by us, by users (e.g., in profiles or descriptions), or by third-party advertising networks (such as Google AdSense or similar services).

Advertising: You acknowledge and agree that the Service may be supported by advertising revenue and may display advertisements and promotions. These advertisements may be targeted to the content of information stored on the Service, queries made through the Service, or other information (subject to our Privacy Policy). The manner, mode, and extent of advertising by StratiZone on the Service are subject to change without specific notice to you.

Affiliate Links: StratiZone may participate in various affiliate marketing programs, which means we may get paid commissions on purchases or sign-ups made through links to retailer or service provider sites (e.g., links to brokers, trading platforms, or other relevant services). Our participation in these programs allows us to support the ongoing operation and development of the Site while keeping core features free for users. We strive to provide disclosures (such as "*Affiliate link*" or similar notices) near such links where practical. Clicking on an affiliate link does not increase the cost to you.

Disclaimer: StratiZone has no control over, and assumes no responsibility for, the content, privacy policies, terms of use, or practices of any Third-Party Content or websites. We do not endorse, warrant, or guarantee the products, services, or information described or offered at these other websites or through advertisements. You further acknowledge and agree that StratiZone shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such Third-Party Content or websites. Your interactions with any third party found on or through our Service, including payment and delivery of goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such third party.

11. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, potentially via a notice on the Site or email. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service. We may also, in the future, offer new services and/or features through the Site (including the release of new tools and resources, or the introduction of fees for certain features). Such new features and/or services shall also be subject to these Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the competent courts located in Noida, Uttar Pradesh, India. You hereby consent to the exclusive jurisdiction and venue of such courts.

13. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy incorporated herein by reference, constitute the entire agreement between you and StratiZone regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
